PRIVACY POLICY

The website located on the Internet at https://www.dobavki.ua/ua (hereinafter referred to as the Website) is operated by DO UA Limited Liability Company, EDRPOU code 45223262 (hereinafter referred to as the Contractor).

Before using the Website, the User is obliged to read this Privacy Policy (hereinafter referred to as the Policy) and express his/her full consent to it, which occurs by further use of the Website, including the provision of his/her personal data by the User in the relevant sections of the Website (filling out registration forms) and marking the consent to this Policy. 

In case of disagreement with this Policy, the User shall refrain from using the Website and leave it. 

The Contractor is responsible for the security of personal data of the Users of the Site, other persons who have contacted the Contractor with any request or claim (you) and respects their rights, in particular those related to the personal data of personal data subjects that it receives in the course of its activities on the Site, and seeks to protect them.

The purpose of the Policy is to inform you about the procedure for collecting, storing and processing personal data and information provided by you through this Site.

The Contractor is the "Personal Data Owner" within the meaning of the Law of Ukraine "On Personal Data Protection" dated 01.06.2010 No. 2297-VI.

The Contractor shall process your personal data only if one of the conditions specified in Article 11 of the Law of Ukraine "On Personal Data Protection" is met, including, but not limited to:

- You have given your consent to the processing of personal data;

- processing is necessary for the possibility of concluding an agreement with you, according to which it is planned to provide services in the form of displaying information for Users about the Goods, Sellers and related information on the Site; providing technical capabilities for ordering the Goods on the Site; ensuring the placement and processing of the Seller's information about the Goods; providing technical capabilities for the Buyer to interact with the Seller in case the Buyer orders the Goods; other actions in accordance with the terms of the Public Offer, providing other information that the User can receive.

This Policy is mandatory for use by employees/contractors/representatives of the Contractor who directly process and/or have access to personal data in connection with the performance of their duties/provision of services.

The Contractor may update the Policy from time to time, including if required by the legislation applicable to the relations defined by this Policy. Therefore, please visit the Website to make sure that you are familiar with the current version of the Policy.

1. DEFINITION OF TERMS

In this Policy, the following terms are used in the following meanings:

personal data owner, controller - the Contractor who determines the purpose of processing personal data, establishes the composition of this data and the procedures for their processing, unless otherwise provided by the legislation of Ukraine;

consent of the personal data subject means a voluntary expression of will of an individual (subject to his/her awareness) to grant permission to process his/her personal data in accordance with the stated purpose of their processing, expressed in writing or in a form that allows to conclude that consent has been granted. The consent of the personal data subject may be provided during registration on the Website by marking the permission to process their personal data;

processing of personal data - any action or set of actions, such as collection, registration, accumulation, storage, adaptation, modification, renewal, use and dissemination (distribution, sale, transfer), depersonalization, destruction of personal data, including with the use of information (automated) systems;

personal data - information or a set of information about an individual who is identified or can be specifically identified;

personal data manager, operator - an individual or legal entity that is authorized by the personal data owner or by law to process this data on behalf of the personal data owner;

subject of personal data, Subject - any individual whose personal data is processed by the Contractor in accordance with its goals and the purpose of processing determined by this Policy.

2. LEGISLATION IN ACCORDANCE WITH WHICH PERSONAL DATA IS PROCESSED 

The processing of your personal data is carried out in accordance with the requirements of the current legislation of Ukraine, including the Law of Ukraine "On Personal Data Protection" dated 01.06.2010 No. 2297-VI.
 

3. SCOPE OF THIS POLICY

This Policy applies to personal data collected by the Contractor through the Site, as well as obtained in other ways to provide services in accordance with the terms of the Public Offer posted on the Site. 

The Website may contain links to other Websites (for informational purposes only) to which this Policy does not apply.

4. PERSONAL DATA AND INFORMATION COLLECTED THROUGH THE SITE

The Contractor receives and stores any information that you enter on the Site when filling out registration forms, provide it in any other way, only to the extent necessary to provide services or perform duties in accordance with the Public Offer posted on the Site (personal identification information and non-personalized identification information). 

In any case, when optional information is requested, the Subject will be notified at the time of collection of such information.

Personal data may be collected and processed automatically when you use the Website (for example, through cookies). 

Personal data contains information that allows you to be identified among other individuals. It includes your:

last name, first name, patronymic;
nickname
e-mail address 
contact phone numbers;
account data (link, address) in Facebook, Instagram, Telegram, WhatsApp, Viber;
address of the place of residence;
photo;
google-id of the user;
facebook-id;
any other personal information that you send us and enter when filling out registration forms on the Website;
information posted by you based on the results of using the Website, reviews, comments, requests to the support service, complaints, claims, other requests.


Non-personally identifiable information means data of a purely statistical nature that does not by itself identify specific individuals or legal entities and which depends on your visits to the Site. For example, this information may include the IP address from which you access the Internet, the date and time of access to the Site, as well as the address of the website from which you followed the link directly to the Site. 

The information received may be stored in the Contractor's contact or administrative databases in connection with cooperation with you or because, in the Contractor's opinion, you may be interested in receiving materials about its activities and services from it. This allows the Contractor to more effectively manage relations with you, improve its Internet resources and services offered to you, as well as to target the materials it may send to you by interests.

The Contractor may receive information about you from other sources, including from publicly available sources of personal data: directories, address books, registers, lists, catalogs, databases, other systematized collections of open information containing personal data posted and published with your knowledge, as well as from third parties who help update, expand and analyze the Contractor's records; identify persons interested in the services; prevent or detect fraud.

The Contractor does not collect through the Website information for the processing of which special requirements are established by law, such as information on racial or ethnic origin, political, religious or ideological beliefs, membership in political parties and trade unions or conviction to a criminal sentence, as well as data related to health, sexual life, biometric or genetic data (in accordance with Article 7 of the Law of Ukraine "On Personal Data Protection").

5. PURPOSES OF PROCESSING AND USE OF PERSONAL DATA

The Contractor needs your personal data so that it can provide you with wide access to the services that can be obtained through the Site, in particular for

ensuring that you have access to the services and information that you want to use on the Site;
to communicate with you, including for the purpose of ordering the Goods selected by you;
responding to your inquiries, comments, messages, etc;
ensuring security and preventing fraud;
providing effective customer service and better understanding of your needs and interests;
personalize your use of the Site;
providing you with information that, in the Contractor's opinion, may be of interest to you, in particular, informing you about similar Products;
improving the content, functionality and convenience of the Site;
improving the Contractor's services;
other purposes specified in this Policy, the Public Offer;
exercise of the functions, powers and duties assigned to the Contractor in accordance with the current legislation of Ukraine, as well as ensuring the implementation of civil, economic and tax relations.
We ask you to provide the personal data that is necessary to order the Service or Goods on the Website, to receive a response to your request/claim. 

If you decide to provide the Contractor with additional personal data, the Contractor will also be able to process it with the required level of protection.
 

6. PROTECTION OF INFORMATION

The Contractor uses generally accepted standards of technological and operational protection of information and personal data from loss, misuse, alteration or destruction. However, despite all efforts, the Contractor cannot guarantee absolute protection against any threats arising beyond its control.

The Contractor shall ensure the application of all relevant confidentiality obligations, as well as technical and organizational security measures to prevent unauthorized or unlawful disclosure or processing of such information and data, their accidental loss, destruction or damage.

The Contractor shall provide access to information and personal data only to authorized employees, contractors, persons who have agreed to ensure the confidentiality of such information and data in accordance with its requirements, as well as to Sellers for placing an Order for the Goods and selling them, and to Buyers for communication regarding the execution of the Order.

The dissemination of personal data without the consent of the Subject or his/her authorized person is allowed in cases determined by law, and only (if necessary) in the interests of national security, economic well-being and human rights. 

The Contractor shall be responsible for the processing of the received personal data in accordance with the requirements of the current legislation of Ukraine and shall impose the corresponding similar obligations on persons who have access to personal data, including those who process them, counterparties with whom it interacts in the process of providing you with services or in the process of processing information received from you.

7. COOKIES.

Cookies are small text files in which the browser can record data received from the server. When you go to a page of the Site, the server can read the information contained in the cookie files. 

The Contractor tries to make your stay on the Site as comfortable as possible. To do this, it is necessary (using cookies) to analyze the behavior and interests of the User, the visitor of the Site. Such analysis will help determine the most convenient interface and navigation of the Site. In particular, the Contractor uses these technologies to:

collecting information about the frequency of use of the Site by Users;
to support the functionality of the Site, for example, to eliminate the need to re-enter input information already in the database or to re-set the settings already set during previous visits to the Site;

8. ACCESS TO PERSONAL DATA

9. TRANSFER OF DATA TO THIRD PARTIES

The Contractor does not transfer personal data to third parties, except when such transfer is required by law, at the request of the Subject or in other cases set forth in this section. 

The Contractor does not sell, lease or provide your personal data for commercial purposes, only for the purpose of fulfilling the obligations established by the Public Offer.

The Contractor has the right to disclose personal data when it believes in good faith that the disclosure complies with the current legislation of Ukraine. 

If necessary or for the reasons set forth in this Policy, personal data may be provided to state and local authorities, courts and law enforcement agencies upon their reasonable requests.

The Contractor may transfer your data to third parties for processing, in particular to IT providers, including cloud service providers.

The Contractor shall store your personal data in accordance with internal regulations and the requirements of the current legislation of Ukraine.
 

10. RIGHTS OF THE SUBJECT

You have the right to:

to know about the sources of collection, location of your personal data, the purpose of their processing, location or place of residence (stay) of the owner or manager of personal data or to give a corresponding order to obtain this information to persons authorized by him/her, except in cases established by the legislation of Ukraine
receive information about the conditions for granting access to personal data, including information about third parties to whom your personal data is transferred;
to access your personal data;
receive a response on whether your personal data is processed no later than 30 calendar days from the date of receipt of the request, except in cases provided for by the legislation of Ukraine, as well as receive the content of such personal data
submit a reasoned request to the personal data controller with an objection to the processing of your personal data;
to submit a reasoned request to change or destroy his/her personal data by any owner and manager of personal data, if such data is processed illegally or is unreliable;
to protect their personal data from unlawful processing and accidental loss, destruction, damage due to intentional concealment, failure to provide or untimely provision, as well as to protect against the provision of information that is inaccurate or discrediting the honor, dignity and business reputation of an individual;
file complaints about the processing of their personal data to the Ukrainian Parliament Commissioner for Human Rights or to the court;
apply for legal remedies in case of violation of the legislation on personal data protection;
to make reservations regarding the restriction of the right to process their personal data when providing consent;
withdraw consent to the processing of personal data;
to know the mechanism of automatic processing of personal data;
to be protected from an automated decision that has legal consequences for you.
You may exercise other rights in accordance with the legislation of Ukraine on personal data protection.

If personal data is deleted at your request, the Contractor will keep only such copies of the information as are necessary to protect its legitimate interests, resolve disputes or perform any transaction pursuant to any agreement you have entered into with the Contractor.

11. DATA STORAGE PERIOD

The Contractor will not store your data for longer than is necessary to fulfill the purpose for which it is processed or to comply with the requirements established by law.

To determine the appropriate retention period, the Contractor determines the nature and category of personal data, the purposes for which it processes them, and whether it can achieve these purposes by other means.

As a general rule, the maximum processing time for personal data is 1095 days from the date of submission of tax returns for the period in which the relevant transaction took place. The specified processing time is in line with the provisions of the Tax Code of Ukraine regarding the retention periods for documents related to the calculation and payment of taxes and fees.

Personal data is subject to deletion or destruction from personal databases in cases established by the legislation of Ukraine.

Personal data is stored for no longer than necessary in accordance with the purpose of its processing. 

The Contractor shall make changes to personal data at your request if such data is unreliable, inaccurate or irrelevant.

12. ADDITIONAL CONDITIONS

The Contractor shall not be liable for any damage or losses incurred by the User or other persons as a result of misunderstanding or misunderstanding of the terms of this Policy.

In the event that any provisions of this Policy are recognized as contrary to the current legislation of Ukraine and/or international law, or as invalid, this does not affect the other provisions of this Policy, they remain in force and continue to operate in full.
